In a fast-paced and time sensitive litigation, Groupe SEB got a favourable order from the Supreme Court today where the Supreme Court stayed the injunction order passed against Groupe SEB till final disposal of the main suit.

Groupe SEB (Defendant) had been injuncted by the Commercial Court, Ahmedabad from selling its air coolers in a suit filed against it by Symphony Limited ( Plaintiff) on the ground that the shape of Symphony air coolers had acquired secondary meaning and the coolers sold by Groupe SEB were identical/ deceptively similar to its air coolers. The said order was also confirmed by the High Court.  With the sword of injunction hanging on its head (as the injunction would operate w.e.f. 20.8.18), the SLP had to be drafted in one day for it to be listed before deadline.

The Supreme Court disposed off the SLP on day one in favour of Groupe SEB, in effect staying the injunction order passed by both the lower courts and directing the main suit to be disposed off within 4 months.
